Minimum annual leave by year of service

The legal minimum runs by year of service from your start date. Many employers use a calendar year instead, which is fine as long as you get at least as much. These are minimums under the Employment Act; for staff outside Part 4 (e.g. managers and executives), payout of unused leave follows the contract.

You can also ask to clear leave during your notice period, or use it to shorten the notice. Leave used that way is not paid out again.

How this works

Employees covered by the Employment Act get paid annual leave once they have worked for the same employer for at least 3 months. The minimum is 7 days in the first year of service, one more day for each further year, and 14 days from the 8th year. Your contract can give more, never less.

For an incomplete year (the first year, or the year you leave), leave is pro-rated: completed months of service ÷ 12 × the entitlement for that year. MOM rounds a fraction of less than half a day down and half a day or more up.

When employment ends for any reason other than misconduct, the employer must pay for unused annual leave at the gross rate of pay, based on the last drawn salary. For a monthly-rated employee a day's gross pay is 12 × monthly gross ÷ (52 × working days a week). Unused leave is forfeited on dismissal for misconduct.

Paid sick leave also starts after 3 months: 5 days of outpatient and 15 days of hospitalisation leave at 3 months, rising to 14 and 60 days from 6 months. The 60 days of hospitalisation leave include the 14 outpatient days.

FAQs

How many days of annual leave am I entitled to in Singapore?

The Employment Act minimum is 7 days in your first year of service, rising by one day each year to 14 days from your 8th year. You must have worked for the employer for at least 3 months to qualify.

How is pro-rated annual leave calculated?

Pro-rated leave is completed months of service ÷ 12 × your yearly entitlement, rounded to the nearest whole day (half a day rounds up). Someone in their first year who has worked 7 full months has earned 7 ÷ 12 × 7 = 4.08, so 4 days.

Will I be paid for unused annual leave when I resign?

Yes. Unless you are dismissed for misconduct, your employer must pay for unused annual leave at your gross daily rate. On S$4,000 gross over a 5-day week, each day is worth S$184.62, so 2 unused days pay S$369.24.

How many days of sick leave do I get in Singapore?

After 6 months of service you get 14 days of paid outpatient sick leave and up to 60 days of hospitalisation leave a year, which includes the 14 outpatient days. At 3 months it is 5 and 15 days, at 4 months 8 and 30, and at 5 months 11 and 45.
